Filing a Special Leave Petition (SLP) in the Supreme Court of India initiates a multi-step review process by the country's highest judicial authority. This article explores the stages that follow an SLP filing, helping petitioners understand what to expect as their appeal progresses.

Preliminary Hearing

  • After an SLP is filed, it goes through a preliminary hearing before a bench of two or more Supreme Court judges. In this initial review, the Court examines the petition to determine if it raises substantial questions of law, public importance, or constitutional issues that justify further examination.
  • During this stage, the petitioner's legal counsel may present concise arguments to highlight the importance of the case. However, the discussion typically focuses on key legal questions rather than an exhaustive review of the facts.

Issuance of Notice to the Respondent

  • If the Supreme Court deems the SLP worthy of further consideration, it issues a notice to the opposing party (respondent) informing them about the petition. This notice allows the respondent to present their counterarguments, often as a counter affidavit. This document provides their perspective on the issues raised in the SLP and any grounds for opposition.
  • However, the Court may dismiss the petition outright if it finds no substantial grounds for appeal, allowing the lower Court's decision to stand.

Admission of the Petition or Dismissal

  • Following the preliminary review, the Court decides whether to "grant leave to appeal." If leave is granted, the SLP is admitted, converting it into a full-fledged appeal (either a Civil or Criminal Appeal) that proceeds to a detailed hearing.
  • If leave is denied, the SLP is dismissed, meaning the Supreme Court will not hear the case further, and the lower Court's decision remains final. The dismissal might indicate that the case does not involve significant legal questions that warrant the Supreme Court's intervention.

Detailed Hearing and Final Judgment

  • If the petition is admitted, a detailed hearing occurs, often before a larger bench. Both parties present their full arguments, evidence, and relevant legal precedents, allowing the Court to thoroughly examine all aspects of the case.
  • After considering all submissions, the Supreme Court delivers a final judgment. This decision can uphold, reverse, or modify the lower Court's ruling based on the merits of the arguments and legal grounds presented.
